Just saw an issue today tried out A-H in 1900, let the game auto generate the fleet and it gave me a bunch of 400 ton Destroyers even though it hadn't been researched and it even let me build new ones using local docks. But I couldn't design a 400 ton Destroyer. Can you post/link to the save for this if possible? Would help us to track down what is going on. Thanks! Here's the save file. Not quite, you need to a thicker belt and larger calibre to trigger the CA tag.
You can build protected cruisers upto 9500t with smaller guns and the game considers them CLs as long as you don't go over a 3.5" belt and 6"(?) gun.
The 8000t limit only applies to newer flat deck armour layout CLs.
So old-fashioned can be slightly bigger, but you are stuck with worse turret layout options.
And newer have to be smaller (until the limit goes upto 10,000t) but with more versatile turrets and CL/AON armour layouts.

That's not what the designer says if you try to build a CL of any type at 2,000t 2. That's an annoying limitation, because it prevents players from designing 1st Class Cruisers using the Protected Scheme that fit into the tonnage range used IRL (the Edgar-class coming in at 7,700t - but that is likely to be less than full load) 3. Protected CLs are complicated for armament restrictions. You can mount up to dual 8" guns or single 13" guns, so a 9.2" armament (as seen on Blake and Edgar class cruisers) fits into that - the current limits don't take into account how the ships were used.
